اذا كان سند الارض يشير الى انها زراعيه فأن البناء أوالسكن يعد سبباً كافياً لطلب التمليك وفق القرار 1198 لسنه 1977 المعدل وليس بالضروره القيام بالغراس … من القرارات الرائعه لمحكمة استئناف بابل بصفتها التمييزيه

مبدأ تمييزي مهم || محكمة التمييز الاتحادية تقضي بأن إهانة المحامي أو تهديده أثناء تأدية واجبات مهنته أو بسببها تستوجب محاكمة مرتكبيها وفق أحكام المادة (٢٢٩) من قانون العقوبات.

الاب المدمن على الكحول لايصلح للحضانة كونه غير مأمون على سلامة الطفل بموجب مدونة الاحكام الشرعية .
إن مجرد مغادرة الزوجة لدار الزوجية لا يسقط حقها في النفقة، إذ لا يتحقق النشوز إلا بصدور حكم قضائي بات يقضي بترك النشوز، وذلك استناداً لأحكام المادة (68) من مدونة الأحكام الشرعية.

حبس المدين بين الزوجين ممنوع قانونا الا في النفقة..... حبس المدين وسيلة استثنائية في التنفيذ لا يجوز اللجوء اليها متى توفرت الموانع القانونية التي تمنع المساس بحرية الانسان ومن اهم هذه الموانع قيام العلاقة الزوجية بين الدائن والمدين حيث يمنع القانون حبس الزوج لصالح الزوجة او العكس اذا كان الدين ناشئا عن التزامات مالية او مطالبات مدنية او حقوق متعلقة بالحياة الزوجية ولا يرد على هذا المنع استثناء سوى حالة واحدة وهي ان…

#قرار_تمييزي قطع نفقة الزوجة لا يستلزم الحصول على حكم بالنشوز اذا ثبت انها تركت دار الزوجية بدون عذر شرعي.
ان المدعى عليه قد شَهّر بسمعة المدعية وشرفها وإتهمها بالخيانة الزوجية وتمت إدانته وفق أحكام المادة ٤٣٣ من قانون العقوبات جراء فعله هذا، بالتالي تكون المدعية قد تعرضت إلى ضرر جسيم لا يمكن أن تستقيم معه الحياة الزوجية وتكون دعواها بطلب التفريق للضرر لها سندها القانوني وحرية بالإجابة .
قرار تمييزي جديد ليس للزوج طلب التفريق طالما انه اختار المذهب الجعفري وطلب الطلاق يكون للزوجة فقط
