Supreme Court held that an insurer is not liable for losses occurring after the insured’s turnover exceeded the sum insured under a Marine Cargo Annual Turnover Policy, where the enhanced premium was not paid in advance, as barred by Section 64VB of the Insurance Act, 1938.
Supreme Court, while modifying a Madras High Court order, reiterated that where a convict receives life imprisonment for murder along with sentences for other offences, the sentences must run concurrently, not consecutively.
Supreme Court dismissed a plea challenging hanging as a method of execution, while allowing future constitutional review if medical or scientific evidence warrants it. The Union Government may also explore alternatives through an expert body to minimise pain and preserve dignity.
