Ну и напомню мысль проф. Медикуса о том, что кредитору можно было бы вменить вину за утрату своего требования к должнику, если он своим поведением сам этому способствовал - например, путем агрессивной рекламы или бесконтрольной выдачи кредитов. Мне кажется, это удачная аналогия дисчарджа с вещным правом и поведением прежнего собственника утраченной вещи. У нас в телефонах есть не одно свидетельство такого поведения…

Швейцария наконец ввела освобождение от долгов. Удивительно, но в «стране банков» до сих пор ее не было. Или вовсе не удивительно, а очень даже закономерно?
